Document Overview

A Codicil is a legal document that allows you to amend, update, or revoke parts of an existing Will without writing a completely new one. It works alongside the original Will and must be stored together with it.

Under the Law of Succession Act (Cap. 160, Section 11), a Codicil must follow the same formalities as a Will:
1. It must be in writing.
2. It must be signed by the testator.
3. It must be attested by at least two competent witnesses who are not beneficiaries.

Purpose of a Codicil:
1. To change executors or guardians named in the Will.
2. To add or remove beneficiaries.
3. To add newly acquired property (e.g., land, car, bank accounts).
4. To update funeral instructions or charitable donations.
5. To correct mistakes in the original Will.

A Codicil is useful for minor changes. If there are extensive changes, it is recommended to write a new Will.

NOTES:
1. A Codicil should always be kept together with the original Will.
2. Too many Codicils can cause confusion. If you are making many changes, consider drafting a new Will.
3. Witnesses must be independent - they cannot be beneficiaries.
4. The Executor must apply for probate using the original Will + Codicils.
