A Revocation of Will is a legal document used to formally cancel a previous Will or Codicil. Once revoked, the old Will becomes invalid, and the person (testator) is considered to have died intestate (without a Will), unless a new Will is executed.
In Kenya, revocation of a Will is recognized under the Law of Succession Act (Cap. 160). A Will can be revoked:
1. By making a written declaration of revocation.
2. By creating a new Will that expressly revokes all earlier Wills.
3. By physical destruction of the old Will (burning, tearing, etc.) with intent to revoke.
NOTES:
1. Revocation should be done in writing to avoid disputes.
2. It must be signed and witnessed like a Will (two competent witnesses who are not beneficiaries).
3. Once revoked, the estate will be distributed under intestacy law unless a new Will is made.
4. If revoking due to major changes (e.g., new marriage or children), it is advisable to create a new Will immediately.
