In Kenya, Wills are governed by the Law of Succession Act (Cap. 160, Laws of Kenya). For a Will to be valid under Section 11 of the Act, it must:
1. Be in writing (typed or handwritten).
2. Be signed by the testator (or by another person at the testator’s direction).
3. Be witnessed by at least two competent witnesses present at the same time.
NOTES:
1. The Will must be signed and dated by the testator.
2. It must be witnessed by two competent adult witnesses who are not beneficiaries.
3. The Will should be stored in a safe place (e.g., with the Executor, a lawyer, or a safe deposit).
4. If the estate is complex (businesses, multiple marriages, international property), a Detailed Will or legal advice is recommended.
