(1) This Act does not apply to—(a) the Kenya Post Office Savings Bank established under the Kenya Post Office Savings Bank Act (Cap. 493B);(b) the Agricultural Finance Corporation established under the Agricultural Finance Corporation Act (Cap. 323);(c) a society registered as a co-operative society under the Co-operative Societies Act (Cap. 490);(d) a microfinance bank licensed under the Microfinance Act (Cap. 493C).(2) Notwithstanding the provisions of subsection (1), where any of the bodies referred to in that subsection is contracted by an institution as an agent to provide banking services on behalf of the institution, this Act shall apply to such body to the extent of the services contracted.
